Policy for Best Practice and Policy Development  revised 4/18/18

This was developed in tandem with the National Association of Social Workers (NASW) Code of Ethics revisions in 2017 which encompass professional standards that now, not only align, with the “mission” of the NASW guidelines to enhance social work practice but include to include our use of technology. It is my preference to utilize the NASW’s Code as a guide even though they are a professional organization and not a law-making body of our government. The NASW is “…the largest organization of professional social workers in the world. NASW now serves 55 chapters throughout the United States, Puerto Rico, the Virgin Islands, Guam, and abroad” (c2017 NASW Code of Ethics). This practice is governed by the belief that they allow their clinician members to receive this guidance to support to best practice, promote social justice and influence policy throughout our government, as a politically and socially driven body of professionals with a passion for ” ..service, social justice, dignity and worth of the person, importance of human relationships, integrity and competence”(c2017 NASW Code of Ethics). These are the core values of practice (c2017 NASW Code of Ethics).

General Privacy Policy ; As a Clinician and Consultant and ( HIPPA FERPA) Confidentiality

As a clinician for nearly 20 years, I strive to uphold the standards of my profession. As a consultant to educators, families, administrators and throughout agencies, state and federal courts; I continue to balance my high standard of care within a modern society that values information and communication through technology. I stand dedicated to offering clients and working with vendors regarding the guidance and knowledge they pursue in various innovative practices in which today's world demands. ). *At present, this practice does not accept nor do we electronically bill insurance carriers for out of network services. This clinician does have a National Provider ID and (if this applies) as a client of the practice, you may choose to do so on your own; all paperwork and codes will be provided to you for this purpose.

I am committed to upholding the “core values of practice” as defined earlier, and insure confidentiality, client, clinician, and any third party, or carrier information, under my practice adheres to my policy and information that which relates to HIPPA (abbreviation for the Health Insurance Portability and Accountability Act of 1996) designates among other safeguards, requires compliance in confidential handling of protected health information for your privacy (NYS Dept. of Health). As per the United States Department if Education, this practice “InspireAmindTM”, and its Owner, Marcy Abramsky is dedicated to The Family Educational Rights and Privacy Act (FERPA) (20 U.S.C. § 1232g; 34 CFR Part 99). This Federal law is in place to protect the privacy of student educational records. The law is imposed on any and on institutions; namely schools who receive, any U.S. Department of Education or government funding. However, this practice also adheres to these laws as an extra measure when working with clients ( students, organizations and or school districts) as we do with every single client. It is the belief of this practice that, federally funded or not, each person and entity have the right to privacy unless otherwise stated in this policy where very specific *exceptions are outlined under law. This practice obtains written consent prior to speaking with anyone regarding your medical health or any business contract or consult without your express consent. If you are a minor, you will have the opportunity to sign as well, unless under 10. As written above, this practice will ask for signed consent from a non-minor student or guardian and/or have consent from any district or organization or third party ( to the best of our knowledge) is participating in any paid service from Marcy Abramsky, LCSW Owner of InspireAmindTM .

*Exceptions to privacy policy –Any texts or emails can remain on a server. It is not a policy to compromise emails or texts, This is shared for your safety regarding harm As a clinician, my legal responsibility surpasses any other; any intern, representative of InspireAmindTM or Owner, Marcy Abramsky, LCSW,  has a responsibility by law to report if a client or consumer in any capacity (an ethical obligation to the broader society exists); has abused a child, is a minor that is abused, or threatens harm to self or others.) There are also legal situations where this practice (extreme) may be asked under law for client medical records, clinician would typically need to obtain client consent, or verify it prior. There may be other situations in which this clinician, may need to notify the police of a situation as it pertains to safety.  Otherwise, no names will be disclosed of patients, when discussing any "like" or related case situations for resources, or to provide education with an individual (not in a educational group setting) with other professionals, without consent.

Clinician and Consultant

This practice will not engage in dual relationships with its clients such as counseling and office or district consulting services with the same person. Clients must be aware that this might lead to appropriate referral of the client if it is to protect the them. It is this clinicians procedure that measures will be taken to prevent harm to the professional therapeutic relationship. Referrals are always appreciated, if there is no consequence or conflict of interest.

Social Media Best Practice Policy

Please be aware that Marcy Abramsky, LCSW and InspireAmindTM, do have an online presence. There are several reasons for this. As an active clinician in my field, through both my InspireAmindTM private practice, motivational and consulting services, I derive enjoyment out of learning from, sharing resources with, and educating others. I aspire to continue my work to positively impact social policies and organizations. My passion for research, creating inventive approaches, and learning innovative techniques to advance the scope of my reach, exemplifies the reality of the need for my digital footprint. Promoting closer peer relationships and responsibilities toward respectful treatment of each other, cultivating sense of value so it can be determined that we deserve such treatment and therefore, improving our overall safety and identification of our own behavior and that of others will serve to improve safety and wellness in our society. In an effort to service people, learn and network and build my practice, there is a promotional aspect to the media presence that attracts people in gaining access to services.

Social Media and Best Practice Policy in Communication***Important Updates for April 2018

I also want to be transparent as to any expectations you may find with my communication practices as a professional clinician in private practice, as a consultant and as a private individual. Please do not take any policy in any personal manner. I do not “friend” or accept requests from current or past clients on any social media websites. This can cause issues with confidentiality and privacy for both client and clinician. I will be scanning over my networking pages over the course of April 2018 in order to transition to this fully. If you choose to “follow” me on Twitter or Instagram, or read anything about me that I did not publish, or are unhappy with the content on my feed etc. that is a personal choice. Similar to FB, be aware if you are posting or acknowledging anything on a “wall” and you are a client, it may reveal your identity. While I have generally practiced this policy for my entire professional career, over the past year and in building InspireAmindTM I have made myself more reachable in this manner, and feel giving this notice and leaving up as my policy (I will post it on my Facebook InspireAmindTM Practice Page and LinkedIn Page and leave it up for the adjustment period over the rest of April, 2018. To reach me, the information / location will always be current on my website or email me at [email protected] As a matter of procedure, [email protected] is the best way to reach me for an appointment or a text to the phone number on the website. If you have an appointment and it is within 24 hours please make sure to call directly or text to alter appointment times. If we haven’t spoken I am happy to speak prior to our initial appointment. I urge you to turn off your location services on any mobile devices while at the office. This puts you at risk, for privacy concerns. I do not keep mine on, either.

Following Social Media Policies NOW Apply (April 18, 2018)

Social Media and Blogs, Websites, Promotions, Ads and Information * PLEASE READ

Our online business will be promoted in a professional manner that should not impact your service in any way. This and the policies set forth are for your confidentiality. No client situations or identities will ever be referred to in any social media blogs, websites, promotions, ads etc. Any advice shared on any online networks, will not be shared directly with a minor (with knowledge) nor will this business in any way engage in any conversations outside the client relationship with a minor in any way whether involving a district/business or for student guidance from this practice and/ or a clinician. Please be mindful, that a minor may at any point, read online content that might influence them regarding a topic. This is important since it is an important part of this practice to tend to the needs of adolescents’ children and families.

As the owner of InspireAmindTM (Marcy Abramsky, LCSW), I am aware of this as well and will carefully review the material disseminated online and certain privacy settings. It was important to me that I call your attention to this and create an awareness that online material may contain blogs related to mature subject matter for research, work with colleagues, and educational or self-help materials posted to assist people in general in their efforts to improve the quality of their lives. All content should be appropriate for pre-teen and up, as it would be displayed on a social media site for 13 and up. I will always put out content that is appropriate and relevant to practice but as a guardian, depending on the age of the child, it is a personal choice as to whether you feel your own child should read them.

Internet Searches

This practice does not regularly employ the use of internet searches on clients. The only time there is a deviation from this procedure is when, as a clinician, there is a considerable concern for anyone’s welfare. As per my ethical responsibility to clients and professionals with whom I work, it is my duty, to my best to take preventative measures if I become aware that you or anyone else could be at risk from any kind of imminent harm, or for any other serious, including, professional concerns. An example could be to check on your well-being or report a safety concern ( such as threats). This is professionally my belief and follows the NASW Code of Ethics as per the revised edition, 2017.

Recommendations

If you are a client of the private practice in a therapeutic relationship and being seen for anything other than business or school consultation services; I will never ask you for an online or written recommendation. This can compromise your privacy and you also have the right to your opinion and to not be solicited for a recommendation, during and after working with a clinician. However, as you should take whatever reviews you may read online regarding my work and/or InspireAmindTM you have a right to your own opinion and to write your own, should you choose.

This policy was created by Marcy Abramsky, heavily influenced by my professional knowledge of ethics, the NASW code of Ethics and the benefits of social progress and awareness of social use. Important *As technology advances, this practice will do the very best to keep up with the emergence of new enhancements and how the ethics in our clinical and consulting practice apply. Rare challenges can surface with technology based social work services and each choice made by this practice will be in good faith. If there ever should be a breach, as one of our clients, you will be notified immediately. This practice takes precautions by utilizing antiviral protection software and encryption for the confidentiality of its clients and, third - party vendors. Many other cautionary measures are taken as well, that can be discussed in person. Due to this, we are not liable for anything beyond our control (past our encryption & specially purchased antiviral software). Please be aware that any emails / texts that you wish to send, are content that is on the internet or WIFI through our provider(s). If you have any questions, please speak freely with me about them. This practice ( Marcy Abramsky, LCSW) is a sole proprietorship in the state of New York and only clinically counsels clients in this state. However, books, materials related to professional and personal opinion separate from Counseling or shared in NASW, FB or LinkedIN or University groups, Twitter etc. that ARE NOT servicing clients clinically through counseling,may be distributed nationally. It remains your choice to chose this clinician or discuss any materials, should you come across them and have the need. My hope is to improve wellness in our society!
